It's hard to imagine the drama that has befallen this district in the last 2 1/2 years.
Donnie Forguson looses to Gretchen Flohr and ends his career with the Water District with his infamous farewell "cancer" speech. General Manager Maupin refuses to provide Director Flohr with requested documents regarding the Forbestown Ditch piping project. Director Flohr sues Water District. Yuba Water Agency grants District $225,725 for Forbestown Ditch piping project. Grand Jury begins investigation of the NYWD, Jury members attend a number of board meetings but no report is provided. Manager Maupin receives $480K from Yuba Water Agency to pipe the Oroleve Ditch and awards contract to Hanson Bros.
Enterprises in Grass Valley. Manager Maupin commandeers Yuba County GIS employee to draw him a gerrymandered division map that moves all of Gary Hawthorne's Division 3 irrigation customers, including himself, into Director Flohr's Division 4. Hawthorne votes for the revised map, thus assuring he cannot run again. Director Terry Brown moves to Florida but not before illegally voting for Manager Maupin's gerrymandered map. Manager Maupin fails to sign Yuba LAFCO application to detach 403 parcels which is required before gerrymandered map can be submitted to Yuba County. Water District division voting map remains as before. Gary Hawthorne decides to run again. Water District files Mitigated Negative Declaration for the Forbestown Ditch piping project with CEQA in June and withdraws filing in August.
Director Flohr prevails in her court case and Manager Maupin is ordered to produce the requested documents, which he does. Documents show no routine maintenance has been done on the Forbestown Ditch since Manger Maupin was hired in 2011. Irrigation water deliveries end by July and 50 county residents sign Demand Letter to Water District to resume water deliveries. Concurrent with the mail out ballots from the Yuba County Elections Department in October, Manager Maupin, fearful of losing his job if the three incumbents are not reelected, pays Smart Marketing $4126.93 from District funds to print and mail out 2,500 previously published newsletter addressed to the District's voters intending to sway voters thus tainting the election. Complaints are made to the FPPC.
Not wanting to lose her job either, Office Manager Leona Harris confers with like minded individuals to set up bogus North Yuba Water District Facebook account to attack, in a mean spirited manner, incumbent challengers. Twenty-five Yuba County residents sign letter to County Supervisors and Yuba Water Agency Directors asking for some action regarding Manager Maupin's campaign newsletter FPPC guidelines violation. County Council makes lengthly explanation of why county can do nothing. Water District spends $600K in legal fees. Informal survey is presented at Board meeting showing 42 respondents of the ~105 irrigation customers, 70% have no confidence of a full water delivery season. Subsequently, Water District Directors declare there will be no irrigation water for 2021. South Feather Water and Power Authority files lawsuit against North Yuba Water District for violating CEQA reporting requirements for the Oroleve Ditch piping project. South Feather lawsuits are in the works. Eric Hansard resigns from water district board and District advertises for a Division 5 replacement.
