An article in the Appeal Democrat about Director Flohr's suing the North Yuba Water District for her attorney fees in the amount of $65,560 plus multiplier fees $43,185. The hearing on this is September 28, 2020. In this article General Manager Jeff Maupin said, The preliminary, draft engineering plans are the engineers' work-product, and the district has never possessed them. The district does not have the right to own, use, distribute and reproduce the engineering firm's files. The district properly responded to Dr. Flohr's CPRA request for the preliminary, draft engineering plans and informed her that the preliminary drafts are exempt from disclosure.
This contradicts the contract. Mr. Maupin signed with NorthStar Engineering on December 4, 2017, which states,
7. Ownership of Documents. All works of authorship and every report, study, spreadsheet, worksheet, plan, design, blueprint, specification, drawing, map, photograph, computer model, computer disk, magnetic tape, CAD data file, computer software and any other document or thing prepared, developed or created by Contractor under this Agreement and provided to District ("Work Product") shall be the property of the District, and District shall have the rights to use, modify, reuse, reproduce, publish, display, broadcast and distribute the Work Product and to prepare derivative and additional documents or works based on the Work Product without further compensation to Contractor or any such party.
