The justification for a Categorial Exemption is 15302(c) Replacement and Reconstruction. This is not a replacement or reconstruction of the existing wood flume. The NYWD is making a false statement of fact. It is a deconstruction of the wooden flume and installing a completely new 42" concrete siphon pipe. Curious that the statement was filed by the Interim General Manager one day before the board voted on the exemption.
